1. Application
The General Business Requirements listed here apply to all of the mutual requirements based on the contract between the Buyer and FAHNEN24 as is at the time of the signing, taking into account the General Warranty Agreement for flag poles and accessories as well as the assembly and maintenance as long as there are no exceptions agreed on in writing.
In case of a contradiction, the following order applies: a) General Warranty Agreement for flag poles and accessories; b) General Business Requirements; c) Law.
Business- or sale requirements of the buyer are not items of the contractual agreement with FAHNEN24.
All additional agreements, changes, additions, extensions and definitions of the law need to be put into writing.
If any given item becomes invalid, all remaining items and agreements in the contract stay untouched and remain fully valid. If any item becomes invalid and does not apply anymore and the contract consequently becomes incomplete, the invalid item must be revised or extended immediately in order to fully realize its initial purpose.
2. Object of Agreement
FAHNEN24 agrees to sell and ship - according to the contractual obligations - all flag poles and accessories ordered by the Buyer.
3. Trade
A contract is created through the acceptance of an order by FAHNEN24. FAHNEN24 informs the Buyer about the agreement with a confirmation or the shipping of the order.
The Buyer must provide billing information to FAHNEN24.
All changes made by the Buyer to an order require a written agreement. Already incurred costs will be billed to the Buyer.
4. Shipping
Shipping depends on the confirmation by FAHNEN24 and is furthermore subject to availability of the product from the manufacturer.
The dates and deadlines provided by FAHNEN24 are - unless other agreements have been made in writing - only estimates. Any given shipping dates are estimates based on experience yet without any certainty. In particular, this applies to shipping delays such as supply shortages through the manufacturer.
If the Buyer denies a shipping, FAHNEN24 is permitted to ??? the goods and store them internally or externally with the Buyer carrying the costs and risk.
Shipping comes out of factory or storage. The Buyer carries all shipping costs and risk.
5. Manufacturing
For custom products the construction designs by FAHNEN24 are mandatory for measurements and execution. FAHNEN24 is permitted to make adjustments based on production-based and technical requirements.
6. Installation
Installation is only guaranteed if FAHNEN24 products are used. Warranty does not apply if parts and accessories by other suppliers are used. . In particular, FAHNEN24 is not responsible for any damages caused by drilling and screw-connections.
7. Prices
Sales taxes have to be added to all prices listed by FAHNEN24.
FAHNEN24 is permitted to adjust prices accordingly if between the signing of the contract and the actual shipping one or more of the following items change: prices of the manufacturers, manufacturing costs, shipping, wages or any other costs that directly or indirectly affect FAHNEN24's products.
8. Payment Requirements
All payments are due within 30 days of billing unless other agreements have been made in writing. After 30 days the Buyer is past due. FAHNEN24 is permitted to add interest according to the interest rate established by the Swiss Kantonalbanken or at least 5%.
If a Buyer is past due or facts become known that question a Buyer's credit, FAHNEN24 is permitted without notification to fully or partially cease all further services to that Buyer until all outstanding debts have been satisfied. All subsequent costs caused by such actions are to be paid by the Buyer.
All payments have to be made in Swiss Francs (CHF) unless another currency has been agreed on in writing.
FAHNEN24 accepts checks only if all related fees are taken care of by the Buyer.
9. Reservation Of Proprietary Rights
All shipped goods remain property of FAHNEN24 until all requirements of FAHNEN24 have been satisfied. The Buyer carries all risks.
The Buyer is not permitted to sell or change any goods protected by the Until all of FAHNEN24s requirements have been satisfied, the Buyer is obligated to maintain and carefully handle and protect against all risks all of FAHNEN24's products that have already been shipped.
10. Warranty
The Buyer has to inspect the goods immediately after shipping and/or installation for potential flaws. Any complaints must occur within 8 days of receiving the goods, otherwise the shipped product or installation will be considered satisfying. In case of any hidden defects, FAHNEN24 has to be informed immediately after discovery. Any belated complaints will void all warranty and any other rights.
If the shipped product has defects or is missing certain qualities or becomes flawed within the warranty period, FAHNEN24 will replace or repair the product. In case replacement and/or repair is unsuccessful or not possible, the Buyer has the right to void the contract or lower the sales price.
The flawed product/item must be returned to FAHNEN24 for inspection in the same condition it was in when the defect was discovered. If the product has been tampered with or changed all warranty will become invalid.
Returning products to FAHNEN24 requires the approval of FAHNEN24. The Buyer is responsible for all costs and risk incurred by the return. The item needs to be returned in the original packaging and include a detailed description of the defect.
FAHNEN24 has the right to check a complaint.The Buyer is also required to submit tests or still pictures of the requested materials to FAHNEN24.
The warranty for aluminum flag poles is 2 years and 1 year for all accessories. Warranty begins when the Buyer receives the goods.
Warranty excludes: worn-out parts, flawed installation or installation with mismatched products; misuse; lack of proper maintenance; damage done on purpose or due to misuse; damage due to act of god shipping or transportation damages.
11. Disclaimer

12. Refusal Of Service
The Buyer cannot refuse or withhold any services due to any counterclaims nor bill any counterclaims, unless it has been recognized by FAHNEN24 or the law.
13. Place Of Court
Place of execution for shipping and billing is the location of FAHNEN24 in Rorschach, 9400, Switzerland. FAHNEN24 is part of the court district based in Rorschach, 9400, Switzerland. Swiss law applies. Please add your General Business Requirements here.
14. Return Policy
The Client has the right to cancel his contract within 7 Days after Agreement. Delivered commodities can be returned if not opened or damaged.
Excluded are: Personified commodities and One-off productions.
